RisingMVP LLC ("RisingMVP", "we", "our", or "us") values your privacy. This
Privacy Policy explains how we collect, use, disclose, and protect your
information when you use our website, platform, and related services
(collectively, the "Services").
RisingMVP LLC provides software that helps sports organizations, parents,
athletes, and authorized users manage registrations, communications, payments,
and administrative activities. RisingMVP LLC is a technology provider and does
not operate, supervise, or control sports programs, events, or athletic
activities.
1. Information We Collect
We collect information provided directly — when users create an account, select
a subscription plan, upload content, register athletes, generate payment
invitations, process payments, or contact support. This may include:
- Name, email address, and phone number
- Organization or school information
- Athlete or participant information provided by parents or organizations
- Parent or guardian contact information, including relationship and, at
- Media files such as photos and videos uploaded by users or organizations
- Subscription plan selection and billing information for RisingMVP
Health and Safety Information
Where a sports organization's registration requests it, and a parent or
authorized user chooses to provide it, we collect limited health and safety
information about a participant — such as **medical conditions, allergies,
prior injuries, medications, and emergency contact and physician details**.
This is used solely to support safe participation (for example, so
organizers can respond appropriately in an emergency). We do not sell it, do
not use it for marketing, and do not make it visible outside the
organization the participant registers with. Providing it is optional.
Payment Processing
RisingMVP LLC does not store full card or banking details. Payments are
processed by third-party processors, principally Stripe, Inc., including Stripe
Connect. Where the Platform lets organizations generate payment links, those may
include parent/guardian contact information, participant identifiers, product
and pricing details, and expiration dates.
**RisingMVP LLC is not the merchant of record and does not hold or control
funds** for organization transactions; those settle directly to the
organization's connected Stripe account. We store limited transaction metadata
(status, timestamps, identifiers) for operational purposes.
Automatically Collected Technical Information
Device information, browser type, IP address, usage statistics, crash logs and
performance metrics, used to maintain reliability, security and performance.
2. How We Use Your Information
To provide and maintain the Platform; create and manage accounts and profiles;
enable organizations to manage registrations and communications; manage
subscriptions; facilitate payment processing; send service, administrative and
(where opted in) SMS notifications; analyze usage to improve functionality;
maintain security and prevent misuse; and provide optional AI-assistant features
(see §4).
RisingMVP LLC does not provide coaching, training, medical or athletic advice,
and does not guarantee athletic outcomes or opportunities.
3. Information Sharing and Service Providers
We may share information: with the sports organization a user registers with or
belongs to; with the service providers listed below; when required by law or
legal process; to protect the rights, safety and security of RisingMVP or its
users; and in connection with a merger, acquisition or sale of assets.
**We do not sell personal information, and we do not use it for third-party
advertising.**

Where a provider may process a child's information, we require by written
agreement that it protect that information and use it only to provide services
to us. This list may change as our providers change; we will update it here.
Athlete Profile Visibility
An athlete's profile is **private to the athlete's family and their sports
organization**. It is not published on the public internet and is not searchable
by anyone outside that organization.
We do not currently offer recruiter access to athlete profiles. A previous
version of the Platform allowed a parent to opt a profile into visibility to
verified recruiters and to a public profile page. **That feature has been
withdrawn, and profiles previously made visible have been made private.** If we
reintroduce it, it will require a parent's separate, affirmative opt-in, will be
revocable at any time, and this Policy will be updated first.
Health and safety information is never included in any externally visible view.
Organizations and Their Responsibilities
Sports organizations decide what information to collect from their families,
how to use it within their programs, and who on their staff may see it. When
RisingMVP processes registration and payment information **at an organization's
direction**, we act as its service provider, and the organization is responsible
for obtaining any consents its own programs require.
For features RisingMVP itself provides and controls — platform analytics,
security, our own communications, and the AI-assistant features in §4 — **we act
as the controller.* [Counsel: this narrows the previous "solely a processor"
framing, which I believe overstated the position and invited a regulator to read
the whole document as an attempt to disclaim.]*
4. AI-Assistant Features
The Platform offers optional AI-assistant features that help authorized users
find and summarize information within their own account. To provide these,
limited relevant data is processed by our AI provider (Anthropic) at the time of
the request. We minimize what is sent — **health and safety information and
precise location are excluded from AI processing** — and the provider does not
use the data to train its models. AI features are available only to
authenticated users acting within their own account.
5. Data Retention 🟥 DECISION NEEDED
We retain personal information for as long as necessary to provide the Services,
comply with legal and financial obligations, prevent fraud or abuse, and
maintain operational backups and logs.
Children's information. We do not retain a child's information
indefinitely. Athlete profile information is retained while the athlete
participates with an associated organization, and for a reasonable period
afterward for legal, financial and operational purposes, after which it is
deleted or anonymized.
**[DECISION — at 18, does an athlete's profile convert to an adult account the
athlete controls, or is it deleted unless re-consented?]**
A parent or guardian may request deletion of their child's information at any
time. We delete a child's information on parent request, and after **[a defined
period]** of inactivity. Some information may be retained where required for
legal or compliance purposes.
*[Engineering note: do not publish any sentence promising automatic deletion at
a specific age until a scheduled job exists to do it. There is none today.]*
6. Data Security
We implement reasonable technical and organizational safeguards designed to
protect personal information from unauthorized access, disclosure, alteration or
destruction. No internet-based system is completely secure, and absolute
security cannot be guaranteed.
Breach notification. If we become aware of a breach of security affecting
personal information, we will notify affected users and any applicable
regulators as required by law, without undue delay.
7. Your Rights and Choices
Depending on your jurisdiction, you may have the right to access, correct,
delete, or obtain a copy of your personal information, and to control profile
visibility. Parents and guardians may review, correct or request deletion of
their athlete's information, and withdraw any consent, at any time by contacting
us.
**We do not sell personal information and do not share it for cross-context
behavioral advertising.** We do not sell or share the personal information of
users under 16 under any circumstances.
8. Children's Privacy 🟨 COUNSEL TO FINALIZE
The Platform is intended for use by adults — parents and legal guardians,
coaches, organization staff, and other authorized representatives. **Athletes do
not have their own logins and do not use the Platform directly.** A child's
information is entered by their parent or guardian, or by an authorized
representative of their sports organization.
We are committed to protecting children's privacy in accordance with the
Children's Online Privacy Protection Act (COPPA) and applicable state law. Today:
- a child's information is limited to what is needed to participate;
- it is not public and not visible outside the child's organization
- we do not knowingly permit a child under 13 to create an account or
- we honour parent and guardian requests to review, correct or delete a child's
We are implementing verifiable parental consent obtained before a child's
profile is created, together with a direct notice to the parent describing what
we collect, how it is used, and with whom it is shared.
> *[Counsel: this section deliberately does NOT claim that verified parental
> consent was obtained for every existing profile, because it was not. **227 of
> 499 athlete profiles have no linked parent account** — created by an
> organization on a family's behalf. The previous live wording ("requires
> parental or guardian consent for users under 13") is untrue of that group and
> is the deceptive-practices exposure you flagged. Please confirm this framing,
> and tell us the scope: under-13 or under-18.]*
Parents and guardians may contact us using §11 to exercise these rights.
9. Cookies and Tracking Technologies
We use cookies and similar technologies for essential functionality (such as
maintaining login sessions) and for analytics (including Google Analytics). We
do not use cookies for third-party advertising or cross-site behavioral
tracking.
10. International Data Transfers
Your information may be transferred to and processed in countries other than
your own. Where that occurs, we take steps to ensure it remains protected in
accordance with applicable data protection laws.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. **For material changes —
and for any change to how we handle children's information — we will provide
notice and request your affirmative acceptance before the change applies to
you.** Other updates are posted with a revised "Last updated" date above.
*[This replaces "continued use constitutes acceptance", which understated what
the Platform actually does: v2 was published requiring acceptance and 208 users
were prompted to accept it.]*
